1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the website www.thewaythrough.cc and all services offered by The Way Through, a trade name of Foxgate Holdings LLC, a Wyoming limited liability company ("The Way Through," "we," "us," or "our"). By accessing our website, making a reservation, purchasing a pre-sale stay, contributing to our crowdfunding campaign, or otherwise engaging with our services, you agree to be bound by these Terms.
If you do not agree, please do not use our website or services.
2. Our Services
The Way Through is a nature-based healing sanctuary and eco-retreat located in Mexico. Our services include:
- Accommodations (treehouses, glamping, and related lodging)
- Wellness workshops, programming, and healing experiences
- Animal guardianship offerings
- Pre-sale of future stays and experiences
- Crowdfunding campaign participation
Some services are offered directly through our website. Others are facilitated through third-party platforms (such as IndieGoGo). By participating through any of these channels, you agree to these Terms as well as any applicable third-party platform terms.
3. Pre-Sales, Deposits, and Crowdfunding Contributions
Nature of pre-sales: The Way Through is currently in development. When you purchase a pre-sale stay, make a deposit, or contribute to our crowdfunding campaign, you are doing so with the understanding that the sanctuary is not yet complete. Renderings, timelines, and descriptions represent our current plans and are subject to change.
Crowdfunding rewards: Contributions made through IndieGoGo or similar platforms are rewards-based. You will receive the experience, perk, or recognition described at your contribution tier. Contributions do not represent equity, ownership, or investment in The Way Through or any related entity.
Deposits: Reservation deposits secure your place for a future stay and are subject to the cancellation and refund terms in Section 7.
No guarantees: While we are committed to bringing The Way Through to life, we cannot guarantee specific opening dates. If the project does not move forward, we will communicate with all contributors in good faith regarding available remedies.
4. Payments
Payments made directly through our website are processed by secure third-party payment processors. By submitting payment information, you represent that you are authorized to use the payment method provided and that the information is accurate.
Payments made through third-party platforms (such as IndieGoGo) are subject to those platforms' payment terms and policies.
All prices are listed in US dollars unless otherwise noted.
5. Stays and Experiences
When you book a stay or experience with The Way Through, the following applies:
- All guests are expected to respect the sanctuary, its land, animals, staff, and other guests
- The Way Through reserves the right to refuse service or remove any guest whose behavior is disruptive, harmful, or inconsistent with the spirit of the community
- Guests are responsible for their personal belongings during their stay
- Certain activities or experiences may involve inherent risks (see Section 8)
6. Animal Guardianship
Animal guardianship offerings allow supporters to symbolically sponsor rescued animals at the sanctuary. Guardianship is a symbolic contribution and does not confer legal ownership, custody, or rights over any animal. Animals remain under the care and responsibility of The Way Through at all times.
7. Cancellations and Refunds
Pre-sale stays and deposits:
- Cancellations made more than 60 days before your scheduled arrival may receive a full credit toward a future stay.
- Cancellations made 30–60 days before arrival may receive a 50% credit (unless otherwise discussed and approved in writing).
- Cancellations made fewer than 30 days before arrival are non-refundable (unless otherwise discussed and approved in writing).
- If The Way Through must cancel a confirmed reservation due to circumstances beyond our control, we will offer a full credit or, at our discretion, a refund.
Crowdfunding contributions:
- Contributions made through IndieGoGo or similar platforms are governed by that platform's refund and cancellation policies.
- Contribution-based perks are non-refundable once fulfilled.
We reserve the right to adjust this policy with reasonable notice.
8. Assumption of Risk
Nature-based retreats involve inherent risks, including uneven terrain, wildlife, outdoor conditions, and physical activity. By booking a stay or participating in any on-site experience, you acknowledge these risks and agree to take reasonable precautions for your own safety. The Way Through is not liable for injury, loss, or damage arising from participation in activities that involve inherent risk, except where caused by our gross negligence.
9. Intellectual Property
All content on thewaythrough.cc — including text, images, video, branding, logos, and the series Everything Keeps Saying Yes — is the property of The Way Through or its content creators and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.
10. User Conduct
When using our website or communicating with us, you agree not to:
- Violate any applicable laws or regulations
- Submit false or misleading information
- Attempt to access systems or data you are not authorized to access
- Harass, threaten, or harm others
- Use our brand, name, or content without permission
11. Disclaimer of Warranties
Our website and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the fullest extent permitted by law, The Way Through and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website, including loss of data, loss of profits, or personal injury, except in cases of gross negligence or willful misconduct.
Our total liability to you for any claim arising from these Terms or your use of our services will not exceed the amount you paid to us in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless The Way Through and its members, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of our services.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms will first be subject to good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in Wyoming, except that either party may seek injunctive relief in a court of competent jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on our website with an updated effective date. Your continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
